ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS AND PARTIES

On the one hand, the supplier of the products, David Martín Coello - Aloha Book Retreats (hereinafter also referred to as the provider, Aloha Book Retreats), with registered office at C/Malva n15, Arona, 38627. Santa Cruz de Tenerife, Spain. N.I.F. 45853690Q, customer service email: info@alohabookretreats.com, being the owner of the website alohabookretreats.com, presents the contractual document that will govern the contracting of the retreats and/or experiences published through the aforementioned website.

David Martín Coello is the owner of a web platform that showcases retreats and experiences, acting as an intermediary for the experience providers. The experience providers are companies that offer different activities promoted through the Aloha Book Retreats website, where they are finally contracted. Aloha Book Retreats functions as a means to book the experience desired by the user.

The relationship between Aloha Book Retreats and the Experience Providers is governed by various terms and conditions that make up their relationship. Each provider acts in a professional manner in offering their experience through the Aloha Book Retreats website and may request acceptance of their own terms and conditions and rules of use, which may include cancellation, disclaimer and limitation of liability policies.

On the other hand, the user/customer (hereinafter referred to as the User) registers on the website by means of a user name and password, and is fully responsible for their use and safekeeping. Furthermore, the User is responsible for the accuracy of the personal data provided to the website provider.

All users accept this document, which implies that the user: Has read and accepts these general conditions of contracting the experience and/or booking from the moment he/she makes the booking or direct contracting, assumes all the obligations set out herein. Has read, understood and understood what is set out here. Is a person of legal age and has sufficient capacity to contract.

Aloha Book Retreats cannot be held responsible for any consequences that may arise from inappropriate use of the experiences presented on the website. .

The supplier reserves the right to unilaterally amend these General Terms and Conditions in order to improve them.

OBJECT

Acceptance by the client: Confirmation of a booking through the alohabookretreats.com website is made by email and automatically implies acceptance of these General Terms and Conditions.

Modification of the General Terms and Conditions: David Martín Coello (Aloha Book Retreats) reserves the right to modify these General Terms and Conditions (GTC) at any time. If changes or modifications are made after a booking has been made, the conditions in force at the time of booking will apply.

Capacity to contract. You must be of legal age and have the legal capacity to contract in order to book or contract an experience.

Scope and nature of the service. The purpose of the current contract is to regulate the contractual relationship between the experience provider, the provider and the user for the contracting and booking of experiences or retreats.

If the Organiser accepts your Booking, a binding agreement is formed between you and the Organiser through the Platform.

Aloha Book Retreats acts as an intermediary in the booking and contracting of experiences, transmitting the relevant booking details to the experience provider with whom you have booked and sending you a confirmation email on their behalf. It is important to note that by booking or contracting an experience, you enter into a direct contractual relationship with the relevant experience provider, and Aloha Book Retreats does not sell or offer any experiences directly.

We are not responsible for errors, such as manifest and typographical errors, inaccurate, misleading or false information, interruptions due to temporary and/or partial server downtime, repairs, upgrades and maintenance of our Platform or other causes, or lack of information. Each provider is responsible at all times for the accuracy, correctness and completeness of the information, both descriptive and related to rates, charges, prices, terms and conditions and availability, appearing on our website.

Although Aloha Book Retreats aims to make the experience offering service as accurate as possible, we cannot verify or guarantee that all information is accurate, complete or correct. In providing our experience booking and reservation service, we rely on information provided by suppliers, who are fully responsible for updating the rates, charges, prices, availability, terms and conditions, and other relevant information that appears on our website.

The content and information on the Experience Booking and Booking Service are the property of Aloha Book Retreats and are protected by intellectual property laws. Your use of the Service is limited to personal, non-commercial use and you are prohibited from reselling, using, copying, displaying, downloading or reproducing the content, information and bookings made without the express consent of Aloha Book Retreats. Any violation of this policy may result in termination of your access to the Service and possible legal action against you.

CONTRACTING OR BOOKING PROCESS

There are two forms of reservation procedure, Reservation Request and Immediate Reservation.

Booking Request: you must fill in the corresponding information to complete the form with your personal and travel details and then the organiser will answer your questions, and finally accept or not.

Immediate Booking: click on the corresponding button and complete the form with your personal and travel details, and send the payment for the booking. Aloha Book Retreats will send an automatic acknowledgement of receipt and, upon receipt of payment and booking confirmation, an official booking confirmation will be sent.

Once the booking has been made, the vouchers and/or documents required for the specific reservation will be sent by e-mail.

When accessing the Website, in order to contract the Services, you must follow all the indications of the purchase procedure and complete the corresponding Conditions and forms for each experience. This implies acceptance of the General and Specific Conditions of application, including the specific conditions of sale of the reserved rate and the voucher or reservation request.

Any general or specific conditions communicated by You shall not be integrated into these Conditions.

The user undertakes to guarantee the truthfulness and accuracy of the information provided, acknowledging that any contract made with false information will be null and void.

In the event that an error is detected in the address provided or other booking information, the user must immediately inform the email address indicated on the website so that the corresponding correction can be made. PAYMENT

When booking an experience with Aloha Book Retreats, the user will be informed of the payment terms and conditions. Generally, a deposit will be requested at the time of booking, the amount of which may vary depending on the experience booked, and can be paid by credit card, Paypal or transfer via the platform.

Once the deposit has been paid, the remaining amount must be paid according to the conditions established by the corresponding professional. If payment is not made by the indicated date, the booking will be automatically cancelled.

PAYMENT METHODS

Payment via PayPal account: The user must have a PayPal account. The transaction is formalised when the order is placed. The order will not be processed until the payment has been authorised by PayPal.

Payment by credit or debit card: The user must have a valid credit or debit card and enter the full digits of the card in the corresponding form. The transaction is formalised at the time of placing the order. Only secure cards that verify the identity of the cardholder are accepted for payment using the method established by your bank, via secure e-commerce.

Payment by bank transfer: The user must send a bank transfer to the indicated number and after receiving the receipt, the booking will be processed and confirmed.

If Aloha Book Retreats suspects or detects any anomaly or fraud, Aloha Book Retreats reserves the right to cancel the transaction for security reasons.
